Information about the non-existence of a right of withdrawal

please note that the services offered via the Beachclub Sonnendeck St. Pauli website are not subject to a right of withdrawal. Specifically:
1. Reservation packages (table reservation including food and drinks)
Booking a reservation package constitutes a contract for the supply of food and drinks as well as the provision of further services in connection with leisure activities, where the contract specifies a particular date for performance. Pursuant to § 312g para. 2 no. 9 BGB, the right of withdrawal is excluded for such contracts.
2. Event tickets
Purchasing tickets for Beachclub events constitutes a contract for the provision of services in connection with leisure activities, where the contract specifies a particular date for performance. Pursuant to § 312g para. 2 no. 9 BGB, the right of withdrawal is excluded for such contracts.
3. Explanation
The statutory exclusion of the right of withdrawal is based on the fact that the operator reserves capacities for the agreed date — in particular table seats, food, drinks and event places — which may no longer be utilisable elsewhere in the event of a withdrawal. The exclusion serves to protect the operator from disproportionate disadvantages that may arise from last-minute cancellations (cf. recital 49 of Directive 2011/83/EU).
4. Binding nature of the booking
Your booking of a reservation package or your purchase of event tickets is binding upon conclusion of the contract in accordance with clause 3 of the General Terms and Conditions of Beachclub Sonnendeck St. Pauli and obliges you to pay the agreed price. There is no right to cancel free of charge.
5. Goodwill rebooking
If you are unable to make your booked date, you are welcome to contact the operator and request a rebooking to another available date. There is no legal entitlement to a rebooking.
